GENERAL TERMS

  1. If we provide samples of some data sets or free data sets – they are free to use by you or your business unit* but cannot be redistributed in any form, for free or for a payment.
  2. To provide the rights to your business, you will need to use your business/work email address on checkout. Using a personal email address only provides right to you as an individual to use the data. Rights granted are non-transferable.
  3. Any data you download is provided for the exclusive use for you or for your primary business unit* (if you used your business/work email to purchase the data), the data may not be redistributed, sold, provided free of charge, shared or repackaged in other data sets or software or apps (packaged or SaaS).
  4. If you need to redistribute the data or merge it with other data to provide value added services or enhanced data services within your organization or as a service used by your customers, please contact us for redistribution or data licensing options.
  5. This data cannot be used for training AI/LLM models.
  6. If you want to use the data internally in large organizations and multiple business units* in a large organization please contact us for enterprise licensing options.
  7. If you plan to use the data in open source products, please contact us for approval.
  8. If you plan to use the data in online or offline publication including but not limited to magazines, news articles, blog posts, infographics, charts, graphs, maps etc., please contact us for approval. Approval is provided in most cases of reasonable use.
  9. Please contact us using your work email, if you feel the data is subject to copyright or violates any laws in your jurisdiction.
  10. All prices on our website are in United States Dollars (USD). We are not responsible for any mistaken assumptions you make based on your local currency also being referred to as Dollar and a $ currency symbol. 

Digital Download
The data is provided to you as a digital download (a computer file) formatted as a Comma Separated Value (CSV) file that can be opened in tools such as Microsoft Excel. The data is provided ‘as-is’ without guaranteed technical support.
We are not responsible if you

  1. cannot open the data or
  2. use the data for any reason or
  3. do not find it useful, valuable or worthy or
  4. do not find it accurate
  5. or any other reason

Refunds
Due to the digital nature of the products, all sales are final and refunds are not allowed. 

Your responsibilities

  1. Please ensure that the data fits your needs by downloading the sample data for each product prior to purchase. Please verify that the fields in that sample file match what you need and expect because every dataset may have different fields. We are not responsible for any assumptions you make prior to downloading the data or if you fail to download the sample and verify that the fields meet your need.
  2. Please ensure you save the data you downloaded.

Data Updates and Refreshes
Unless you purchase a subscription, the data you purchase is available as a one-time download. It does not include any refreshes or updated data over time.

The data is available for download for 30 days after your purchase using the download links provided to you. Please download and store the data safely as soon as you purchase the data. If for any reason, you need to download the same data again 30 days after your initial purchase, you will need to purchase it again.

Data Sources
The primary source data of this data store  is the official Brand or Company website and their store locator. This data is augmented in certain cases with other publicly available data. We do not provide and private or proprietary data.
In some cases, the Brand websites may be inaccurate or outdated or not accessible anymore (out of business).

Data Ownership
We do not claim ownership or copyrights for the data, we only charge for the effort required to gather, clean and structure the data.

Data Accuracy and Verification
We make commercially and technically reasonable efforts to verify the accuracy of the data commensurate with the pricing for each dataset. These checks are virtual and technical in nature.

However, we do not perform any physical verification of the data such as calling the phone numbers to see if they ring at the right location, or driving to each location to verify the address or trying to open the doors of the location during their open or closed hours to verify each time slot they publish on their website. Such efforts would be render this data commercially unviable.

Data Discrepancies and Reporting
We encourage you to report any perceived discrepancies to us with proof, and we will make commercially reasonable efforts to identify any inaccuracies.  If the discrepancies are in comparison to the official brand or company websites, we will address those issues provided they are technically possible to address. However, we are not obligated to address these reported discrepancies if the source of the “proof” is from random websites (even if it is Google Maps) or anecdotal or personal experience. 

Warranties, Guarantees and Representations
We make no representations or provide any warranties regarding the accuracy of the data we provide.  We make no guarantees about the quality of the datasets or its eventual value to your business need.

Subscriptions and Cancellations
All recurring subscriptions will continue to be billed until they are explicitly canceled. Any recurring subscription cancellations require a 30 day notice and can only be canceled at the upcoming renewal period. No refunds will be issued retroactively on cancellations.

LEGAL PROVISIONS

Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall this store, its affiliates, or its contributors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the data. Under no circumstances will this store be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the data or your account. In no event shall our total cumulative liability exceed the amount you paid for the specific dataset giving rise to the claim.

Indemnification
You agree to defend, indemnify, and hold harmless this store and its employees, contractors, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the data; (ii) your violation of any term of these Terms and Conditions; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

Governing Law
These Terms shall be governed and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within the Commonwealth of Massachusetts for the resolution of any disputes arising out of or relating to these Terms or your use of the data.

Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
